Collection of Outstanding Freight Balances and Detention Charges

We collect outstanding freight balances, from calculating the amounts due through to formally notifying the debtor. The outstanding balance is the difference between the agreed amount and what was actually paid to the carrier. Our consultancy ensures this amount is identified and collected safely and efficiently.

We also calculate and collect vehicle detention charges in accordance with Law 11.442/2007, which governs road freight transportation. Detention charges are due when a vehicle is held for longer than the permitted loading or unloading time, and we handle all the document verification needed to formally claim them from the contracting party.

Frequently Asked Questions

  • How long does an out-of-court debt collection process take?

The timeframe varies depending on the complexity of the case and the debtor’s response, but out-of-court negotiations are usually faster than legal proceedings, with initial discussions taking place within a few days after the documents have been reviewed.
  • What documents do I need to submit to start a debt collection matter?

You will generally need a contract or invoice for the service/freight, proof of delivery or service, and the debtor's registration details.
  • Do detention charges apply to all types of transportation?

The calculation follows the criteria set out in Law 11.442/2007 and depends on the recorded waiting time and documentary proof of delays in loading or unloading.
  • Do I need to file a lawsuit to collect a debt?

No; our consultancy prioritizes out-of-court mediation as the first step, turning to legal proceedings only when negotiation is not possible.
